                <text>"The Namibian customary system and its administration was severely gender imbalanced and both opponents and proponents of gender equality long believed that women’s rights and traditional rule were eternal foes. Whether or not this was the case in pre-colonial times is not certain, as the presumption of women’s traditional inferiority within such systems is highly disputable. What is clear is that colonial intervention during the twentieth century promoted changes in local customary norms, resulting in extensive gender disparity in Namibia. Women leaders were all but purged from the local traditional arena and women were largely excluded from participation in traditional courts. As such, the emerging structures of the colonial tribal system evolved into all male domains. Other factors, such as the emergence of male contract labor resulting in the introduction of a male controlled cash economy, as well as the influence of Western missionaries and Christianity, exacerbated the subordinate position of women in society and combined to create a widespread belief in Namibia that traditional rule could not and would not accommodate women’s rights. In particular, the traditional system included norms that were detrimental to women’s rights. A salient example is the customary inheritance norm that states that upon a man’s death, his estate is inherited by his matrilineal family. Despite a customary obligation of the husband’s family to support needy widows and children, widows and their children were often chased out of the house, back to the widow’s matrilineal family, in a practice often referred to as ‘widow chasing’ or ‘property grabbing’. Notwithstanding these shortcomings, traditional leaders played and continue to play an important role in present-day rural Namibia, with evidence showing that despite regional differences and individual dissatisfaction, traditional leadership is considered a necessary and viable institution. Empirical studies undertaken in the mid-1990s showed a positive attitude towards traditional authority among respondents in both the north and south of Namibia. Notably, support for traditional leadership did not preclude negative feelings toward the incumbent traditional leaders. In this context, any intervention aimed at empowering women in Namibia would likely have considerably more impact if it addressed the customary sphere."</text>

                <text>History plays an increasingly important role in anthropological discussions. Historical sources for the cultures and societies traditionally studies by anthropologists are, however, scant. This not only affects anthropological research but it greatly affects identity building processes int eh independent nations of the Third World. Most of the early descriptions of the different cultures have been produced by travellers, traders and missionaries. The value of these sources has been recognized for a long time among the experts, but most of the collections have been buried in the archives of the former colonial powers, Finnish missionaries have worked in Namibia for more than a hundred years. From the very beginning they accumulated information about the local cultures. Maija Hiltunen has made a great contribution in this volume to the study of the area by publishing her account of magical practices. She thus continues the work begun earlier with Witchcraft and Sorcery in Ovambo, 1986. Both works make vast amounts of information collected by Finnish missionaries accessible not only to researchers able to read Finnish but also to a wider audience.</text>

                <text>This Discussion Paper highlights in complementary ways problems and challenges for governance issues under centralised state agencies, which base their authority and legitimacy on a dominant party and its influence. The case study on Namibia argues for a need for parliamentary and administrative reform to improve the efficiency of lawmakers. The Botswana chapter explores the decision on the location of the country’s second university as an act without consultation of the local population. The Zimbabwe paper advocates an approach in favour of using the African Peer Review Mechanism as an instrument to assist in a change towards better governance. All the authors have intimate knowledge of the matters discussed through their own involvement with the respective cases and/or their individual positioning within these societies. This publication is among the final results of the project “Liberation and Democracy in Southern Africa” (LiDeSA), which was undertaken at the Institute between 2001 and 2006.</text>

                <text>M.A. Dissertation - National parks have been established in the Third World throughout the last century without consulting local people. Usually management plans of these areas fail to include the local residents. International agreements have been made in the past decades to make local people gain rights in these areas. The parks make a clear separation between human beings and non-human nature. To explain this, the nature vs. culture dichotomy will be used. The focus in the project is on the Topnaar people, the local residents of theh Namib Naukluft Park in the Central Namib Desert. The aim is to answer whether, and how, they feel affected by the fact that they live within a proclaimed national. Since the proclamation of the park in 1907 their presence has been ignored in all park law. The fieldwork was carried out in Namibia in the spring 2009. Qualitative ethnographic research methods were used for data gathering. People within the Topnaar community were interviewed as well as ministry officials, NGO employees and consultants. The research showed that the existence of the community is generally acknowledged and the government has been trying to facilitate their livelihoods within the park since the independence of Namibia in 1990. Factors that could be linked to the park did not seem to affect their livelihoods. Factors of a more general nature seemed to affect them more, such as lack of water and leadership problems.</text>

                  <text>Basler Afrika Bibliographien (BAB) is a centre of documentation and expertise on Namibia and southern Africa, located in Basel, Switzerland. The institution comprises an archive, a specialist library and a publishing house, in addition to offering scholarly, cultural and socio-political events.&#13;
&#13;
Its books and documents on Namibia are of international renown, and are known among experts as the most comprehensive documentation outside of Namibia. Among its holdings is a collection of rare books with volumes on Africa going back to the 16th century, a large collection of African posters and extensive historical archives of images, sound recordings, manuscripts and ephemera. Its collections are complemented by scholarly publication activities.</text>

It is the only organisation of its kind in Namibia. It has a head office in Windhoek, Namibia's capital, along with two regional offices. It is funded by national and international donor organisations as well as individuals. Its work is supervised by the Legal Assistance Trust, whose trustees include legal practitioners, other professionals and community leaders.&lt;/span&gt;

&lt;/ul&gt;&lt;p&gt;&lt;strong&gt;Litigation&lt;/strong&gt;&lt;br /&gt;The Legal Assistance Centre is a public interest law firm based in Windhoek.The LAC only takes on public interest cases. A public interest case is a legal case which will have a wider impact on the community than just assisting the individual concerned. Such a case may establish a new legal rule, which will change the law for the entire country or address a discriminatory policy or practice. Or it may attract attention to a problem that is affecting many people.&lt;/p&gt;
&lt;p&gt;Examples of cases taken up by the Legal Assistance Centre include:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;The right of a school learner to return to school after her child was born&lt;/li&gt;
&lt;li&gt;The right of an accused in a complicated criminal trial to obtain legal aid&lt;/li&gt;

&lt;li&gt;The right of a HIV-positive person not to be dismissed from employment based on their HIV status&lt;/li&gt;

                <text>Two issues have been at the forefront of public discourse regarding commercial sex work in Namibia: HIV/AIDS and legal reform. Although there has been significant legal reform in other areas, the Combating of Immoral Practices Act (No. 21 of 1980) which was enacted during the colonial era remains unchanged in regards to commercial sex. The Act criminalises several sex-related activities including soliciting sex in public, pandering, and keeping a brothel. It is genderbiased, mentioning women but not men as those who potentially sell sex. Research has proven that Namibian sex workers are at great risk of contracting HIV/AIDS, are often forced to have unsafe sex, and suffer from sexual violence and police harassment. (LAC 2002, LeBeau 2007). The Legal Assistance Centre (LAC) has been at the forefront of the efforts to decriminalise sex work. It is believed that removing the criminality from sex work will empower sex workers to better negotiate safer sex practices and protect their human rights. However, decriminalisation remains a controversial issue and has not been supported by the government, church organisations, or the general public (LAC 2002). Morality and national pride seem to be the justification for the continuation of the marginalisation of sex workers. LAC’s research, conducted by their Gender Research and Advocacy Project in 2001 and published as a report entitled Whose Body is it?: Commercial Sex Work and the Law in Namibia, is the largest and most comprehensive study of sex work in Namibia. One hundred and forty-eight sex workers from five different towns were interviewed. In this paper I will present the findings from interviews conducted with 62 sex workers in 2006 and compare these findings with LAC’s research to see if the profile or situation of sex workers has changed over the last five years. A comparison of the two data sets suggests that the risk of physical abuse, police harassment, and forced unsafe sex are increasing and that criminality of sex work forces sex workers to operate under life-threatening conditions.</text>

                <text>Published PhD Dissertation - This study discusses the legitimacy basis of political power and its changes in historical African societies. It starts from Luc de Heusch's tenet that political power required a legitimacy basis of a spiritual kind, often formulated as sacred kingship. In ancient and pre-literate societies such kings were held to be responsible for the fertility of man, land and cattle. The king was a paradoxical figure, symbolising society, but standing above it, while simultaneously being its victim by being ritually killed at old age. This was also how Owambo sacred kings were conceived. De Heusch suggested that African kings derived their power over fertility from having been made 'sacred monsters' in the rituals of installation. With the example of Owambo kingship, this study argues that the transgressive and monstrous aspect is only one of several dimension of a king's sacredness and brings out the nurturing and symbolically female aspect, identified but not analysed further by de Heusch. In the Owambo kingly installation a king-elect was made sacred, and part of it was that a link was ritually created to the early owners of the land. Their consent made it possible for the king to promote fertility and to appropriate power emblems needed for ruling. In the kingdom of Ondonga the early owners of the land were the spirits of early Bushman inhabitants and those of an early kingly clan, both neglected in public memory. The sacred dimension of kingship was further augmented when kings manipulated and appropriated rain rituals and initiation rituals, both of which were related to fertility. The study argues that even though there were aspects of the 'sacred monster' in Owambo kingship, its manifestation was, in part, a distortion of the reciprocal aspect of kingship that was expressed in the homage paid to various ancestor spirits. A change in succession practices from ritual regicide to political assassination took place concomitant with the introduction of firearms, and this broke the sacrificial aspect of sacred kingship paving the way for a more predatory form of kingship while the sacred status of the king was retained.</text>
